CCS Abogados, bufete en el cual la CETM deposit\u00f3 su confianza para defender los intereses de los asociados contra el c\u00e1rtel de Fabricantes de camiones, ha conseguido la primera sentencia que se dicta en Espa\u00f1a (y tambi\u00e9n en Europa) en la cual un juzgado estima \u00edntegramente la demanda presentada y da validez al informe pericial aportado a fin de cuantificar el sobrecoste causado por el c\u00e1rtel.<\/p>\n
Como es sabido, la Comisi\u00f3n Europea sancion\u00f3 en 2016 con 2.930 millones de euros a los fabricantes MAN, Volvo\/Renault, Iveco, Daimler (Mercedes Benz) y DAF, y en 2017 con 880 millones a Scania, por haber pactado los precios de venta de sus veh\u00edculos y por haber repercutido sobre el comprador los costes derivados del cumplimiento de las normas en materia de emisiones contaminantes. Es la mayor multa impuesta por Bruselas hasta la fecha en materia de Derecho de la Competencia.<\/p>\n
Pues bien, el Juzgado de lo Mercantil no 3 de Valencia ha dictado la primera sentencia espa\u00f1ola (fecha 30 de diciembre de 2019, procedimiento 317\/2019) que confirma \u00edntegramente la demanda y valida la prueba pericial aportada, en este caso por CCS, bufete que gestiona la reclamaci\u00f3n de 35.000 camiones y 4.000 demandas en el marco del macro proceso contra el c\u00e1rtel europeo de fabricantes de camiones. El modelo de prueba pericial presentada por CCS, metodol\u00f3gicamente alineado con el que acompa\u00f1a a las demandas presentadas en otros pa\u00edses europeos y diferente a todos los dem\u00e1s aportados ante los juzgados espa\u00f1oles, cuantifica la media del da\u00f1o causado por el c\u00e1rtel a lo largo de los 14 a\u00f1os de duraci\u00f3n en el 16,35% del coste (sin impuestos) de cada cami\u00f3n. El juzgado valenciano reconoce, adem\u00e1s, a favor del transportista demandante, los intereses legales desde la fecha de compra del cami\u00f3n hasta la fecha de la
presentaci\u00f3n de la demanda, e intereses procesales adicionales desde esta \u00faltima hasta la fecha en que se ejecute la sentencia.<\/p>\n
Es especialmente ilustrativo lo que dice el Fundamento Jur\u00eddico no 73 de la sentencia:<\/p>\n
\u201cEn efecto, creo que el informe CCS resiste suficientemente su examen seg\u00fan los criterios de valoraci\u00f3n probatoria anteriormente expresados, as\u00ed:<\/em><\/p>\n (i) El informe se asienta sobre una interpretaci\u00f3n de las caracter\u00edsticas de la infracci\u00f3n sancionada por la Comisi\u00f3n que es coherente con la visi\u00f3n plasmada en el fundamento oportuno de esta resoluci\u00f3n\u201d.<\/em><\/p>\n En el mismo Fundamento Jur\u00eddico, la sentencia destaca que \u201cLos peritos han realizado una b\u00fasqueda proactiva de datos sobre los que desarrollar sus modelos, que parecen id\u00f3neos para recrear los efectos de la infracci\u00f3n y que han sido puestos a disposici\u00f3n de la parte demandada desde el inicio del proceso o en un momento posterior pero igualmente relevante\u201d.\u00a0<\/em><\/p>\n El Tribunal tambi\u00e9n afirma que \u201cen definitiva, el informe CCS es cuantitativa y cualitativamente transparente, muy intenso y, por unas y otras cosas, convincente en ausencia de un informe mejor fundado que lo refute […]\u201d<\/em><\/p>\n Igualmente pone en valor la sentencia que \u201cEl estudio [el de CCS] no se contenta con la expresi\u00f3n de un sobrecoste medio, sino que trata de individualizar los da\u00f1os eventualmente sufridos por la parte actora mediante la recreaci\u00f3n de un iter cronol\u00f3gico sobre la mayor eficiencia del c\u00e1rtel en la repercusi\u00f3n de sobreprecios con el paso del tiempo\u201d.<\/em><\/p>\n CCS Abogados obtiene, as\u00ed, la estimaci\u00f3n \u00edntegra de su demanda y la confirmaci\u00f3n de la validez del informe pericial que la acompa\u00f1aba, particularmente las garant\u00edas de la metodolog\u00eda empleada.
