El Tribunal Supremo considera que no se justifica prohibir a los camiones de cuatro ejes o m\u00e1s circular por la N-232 y N-124 de la comunidad Aut\u00f3noma de la Rioja y obligarles a circular por la autopista de peaje AP-68.<\/p>\n
De esta manera, se da la raz\u00f3n a nuestro asociado, Grupo Log\u00edstico Arnedo S.L., que ha recurrido el establecimiento de esta restricci\u00f3n al considerar que dicha medida carece de cobertura legal al no haberse acreditado en el expediente administrativo la congesti\u00f3n del tr\u00e1fico, la contaminaci\u00f3n ac\u00fastica y la siniestralidad alegadas para poner en marcha esta injusta prohibici\u00f3n, adem\u00e1s del enorme perjuicio econ\u00f3mico que supone tener que transitar obligatoriamente por la autopista, abonando el consiguiente peaje, todos los d\u00edas del a\u00f1o.<\/p>\n
El Tribunal Supremo aclara que las restricciones a la circulaci\u00f3n de camiones s\u00f3lo se justifican, tal y como viene defendiendo\u00a0 hist\u00f3ricamente la Confederaci\u00f3n Espa\u00f1ola de Transporte de Mercanc\u00edas (CETM), en \u201cocasiones puntuales y concretas tales como fines de
semana, vacaciones, etc.\u201d. Igualmente, el Supremo establece que la imposici\u00f3n de cualquier otra restricci\u00f3n \u201cdeber\u00e1 estar justificada en los pertinentes estudios que acrediten que las medidas acordadas son las m\u00e1s adecuadas al fin buscado\u201d.<\/p>\n
La CETM celebra la publicaci\u00f3n de esta sentencia que refrenda nuestro punto de vista de que la imposici\u00f3n de circular obligatoriamente por una autopista de peaje constituye una injusticia. Adem\u00e1s, en nuestra opini\u00f3n, esta sentencia establece un precedente fundamental para que el Tribunal Superior de Justicia de Madrid, \u00f3rgano que est\u00e1 dirimiendo sobre este asunto, ratifique lo antes posible la eliminaci\u00f3n de los desv\u00edos obligatorios establecidos en la Resoluci\u00f3n de la Direcci\u00f3n General de Tr\u00e1fico, que seguir\u00e1n en vigor hasta que esto ocurra, en base a los impecables fundamentos jur\u00eddicos expuestos en la sentencia del Supremo.<\/p>\n
